How mediation works
Mediation is a collaborative process facilitated by a neutral mediator. The mediator's role is to guide parties in conflict toward a voluntary agreement through open communication and constructive dialogue. Unlike a courtroom setting, where a judge makes decisions, mediation empowers the parties themselves to craft mutually agreeable solutions.
Initial consultation
The mediator will offer an initial 30-minute consultation to the parties to discuss the mediation process, assess whether mediation is appropriate for their case, and answer any questions.
Mediation sessions
If the parties agree to proceed with mediation, the mediator will typically schedule 2 or 3 mediation sessions or more if required. These sessions are 60 minutes per session. During these sessions, the mediator will work with the parties to identify the issues in dispute, explore possible solutions, facilitate negotiation, and reach a mutually beneficial settlement.
Agreements
If the parties are able to reach an agreement, the mediator will draft an agreement that reflects the terms that the parties have agreed upon. The parties will then review and sign the agreement if they are satisfied with its terms.
Court filing
The settlement agreement can be made by an order of the court. Our mediators can assist the parties in this litigation process.
